Terms & Conditions
Like almost everything in life, our services come with a few basic T&C's, just to keep everything fair for all parties concerned. Life is short, so we will keep our T&C's the same.
All references to “ZEN Interiors” and Moniiki™ in these terms and conditions are deemed to refer to ZEN Interiors (Pty) Ltd (registration number 2019/141204/07).
Please note that these terms and conditions differ slightly from ZEN Interiors' online shop's terms and conditions, which can be found here.
1.1. ZEN Interiors rely on graphical means to represent ideas, designs and products, but clients should be aware that due to technological limitations, colour and materials might not be accurately displayed on different devices, printouts or brochures. Please request physical samples or visit the relevant showrooms for accurate references.
1.2. ZEN Interiors will always endeavour to provide up to date and accurate information, but in the unlikely event that an error or omission occurs, ZEN Interiors do not assume any liability.
1.3. ZEN Interiors cannot be held liable for any damages or losses that clients incur from using any of ZEN Interiors' services, products or the information provided.
1.4. If any of ZEN Interiors' terms and conditions are found to be unlawful, it will not affect the validity of the rest of the terms and conditions.
2. Pricing, quotations and deposits
2.1. ZEN Interiors will only be bound by quotations in writing, as pricing provided verbally are only considered an estimate.
2.2 ZEN Interiors do not carry stock on hand, which means that quotations are always subject to stock availability at the suppliers, as well as their price fluctuations, which are due to the constantly fluctuating exchange rate.
2.3 Accepting a quotation and placing an order constitute the client's offer to purchase a product or service from ZEN Interiors. ZEN Interiors only deem a client's offer as acceptable once the required payment has been made and cleared in ZEN Interiors account, and the available stock is ordered and paid for at the suppliers.
2.4 Products must be paid for in full before any orders can be placed at the suppliers.
2.5 Due to ZEN Interiors' contracts with the suppliers, they will not allocate or reserve stock unless payment has been made and cleared into their accounts.
2.6 It is the client's responsibility to ensure that the quotation’s information, quantities, pricing, etc are correct before placing an order and making payment. Accepting a quotation means that clients agree to and confirm the accuracy of the information provided.
2.7 For set price design work, a 50% upfront payment is required before work commences.
2.8 For hourly rate projects, ZEN Interiors will require 3 hours’ worth of labour paid upfront, which will then be deducted again from the client's first invoice.
2.9 Clients that are late or unable to keep an appointment without any practical advance notice, will be invoiced at ZEN Interiors' regular hourly rate for the allotted time, as it still denotes a time commitment from ZEN Interiors.
3.1 Electronic Fund Transfers (EFT’s) between different banks, and sometimes even between accounts held at the same bank, can take up to three business days.
3.2 A notification of funds being paid is only that – a notification. Only once an EFT clears into ZEN Interiors' account will the client's account be considered as being paid.
3.3 Full payment is due upon completion of the design, order, installation, delivery or collection. Failure to pay may result in the debt being turned over to a collections agency and reporting to the credit bureau. Clients will be responsible for all costs incurred by ZEN Interiors, collection agencies, or court fees incurred by litigation for failure to pay.
3.4 Stock purchased for clients on order remain ZEN Interiors' property until fully paid by the client.
4. Returns, exchanges, refunds and warranties
4.1 Products and materials that are made or cut to the client's specification are bespoke in nature, and cannot be returned, exchanged or refunded, unless it is in terms of the relevant warranties.
4.2 Altered or damaged products, especially without their original packaging or that is not in a resellable condition cannot be returned, exchanged or refunded.
4.3 A client changing their mind regarding a product does not constitute a reason for a return, exchange or a refund.
4.4 If a return, exchange or refund is warranted due to a flawed or incorrectly supplied product, it must be requested by the client within ten days from the invoice date.
4.5 Warranties does not cover wear and tear from normal use, or damages from improper use, maintenance or cleaning, or lack thereof.
4.6 A handling fee of 30% will be levied on all returned goods, unless agreed differently beforehand, and in writing.
4.7 Warranties are covered by the product manufacturers or their local supplier representatives, ZEN Interiors only act as an intermediary between the relevant parties.
4.8 Warranties typically cover production faults, and will be voided by negligence, usage that beyond what is consider typical for the product, or incorrect maintenance resulting in damage or reduced lifespan for the product. Clients must familiarize themselves with the relevant product brochures, guides and warranty statements.
4.9 ZEN Interiors require the client's original invoice for all returns, exchanges, refunds and warranty claims.
5. Condition of goods
5.1 Textile quality standards are governed by SABS, and their 5-6 flaws per 50 meters standard will be applied.
5.2 Dye-lot variations occur in all textiles and are unavoidable. Subtle textures, colour and weaving irregularities associated with textiles are not considered to be defects.
5.3 Cut fabrics with a width variation less than +/- 3% are deemed acceptable, while a measuring allowance of 1% will be considered accurate.
5.4 Keep in mind that due to production methods, pattern repeats may vary from time to time.
5.5 Natural products are unique by their very nature, and will vary in physical appearance and properties, which are deemed normal and acceptable.
5.6 Care and washing instructions should be followed as per the directions.
6. Deliveries and installations
6.1 Product deliveries and installations are the client's responsibility, unless ZEN Interiors agree to handle either or both on the client's behalf through one of ZEN Interiors' agents, which will be for the client's expense.
6.2 Clients are required to ensure that safe, adequate and accessible location and space is available for both the delivery, movement and installation of products.
7. Intellectual property
7.1 ZEN Interiors retain the copy and intellectual property rights on all products and designs provided, clients are not allowed to sell it or reproduce it in another project, unless ZEN Interiors agreed otherwise in writing.
7.2 Clients are not allowed to copy, reproduce, modify or distribute any of ZEN Interiors' designs or the website’s content in any way.
7.3 All intellectual property rights, including copyright and trademarks embodied in media such as, but not limited to, logos, images or text remain their respective owners’ property, ZEN Interiors' included.
8. T&C's pertaining directly to Moniiki™
8.1 A first consultation is required before Moniiki™ can provide an estimate.
8.2 Final quotations are dependent on the final materials purchased, since design changes might be applicable due to the available materials.
8.3 Changes that clients request during the mock-up and fitting phase that drastically change the construction or change the design will incur extra costs.
8.4 Weight loss or gain that result in alterations will also incur extra costs (please note dear brides, bride’s maids and matrics!).
8.5 A non-refundable 50% deposit is required before work will commence.
8.6 Clients that are late or unable to keep a consultation without at least an hour advance notice, will be invoiced an additional R100-00 fee to the final invoice per consultation missed.
8.7 A few important points regarding fittings:
8.7.1 Fitted garments require fittings to adjust the garment to the client's specific dimensions. Final fittings are therefore critical to make the final adjustments.
8.7.2 If clients are unable to attend the final fittings as per the schedule agreed to during previous fittings or as per the quotation, and Moniiki™ then have to complete the client's garment ‘blind’, the client will be held liable for the extra costs in time and materials due to any potential alterations that is then required and which could have been avoided with the final fittings, and Moniiki™ will bill the client accordingly.
8.7.3 The same holds for requests to do a rush job where the garment is finished to a minimum wearable degree, which then involves alterations to complete afterwards.
8.8 Full payment is due upon completion of order or alteration when collecting the garment.
8.9 Products and materials that are made or cut to the client's specifications are bespoke in nature, and cannot be returned, exchanged or refunded.
8.10 Fabrics supplied by the client must be pre-washed by the client to negate any possible shrinkage, and clients should buy extra fabric as a precaution (confirm the recommended amount with Moniiki™ before purchasing any fabric).
8.11 Moniiki™ will not be held liable for any faulty or unsatisfactory results due to materials purchased against the professional advice provided for a client's requested design.
8.12 Extra fees will be applicable for afterhours consultations. Please have a look at ZEN Interiors' trading hours here .
8.13 Call out fees might be applicable depending on the location, please confirm with Moniiki™ before scheduling to meet off premises.
9. Acceptance of these terms and conditions
9.1 By making use of any of ZEN Interiors' services, purchasing any of the products on offer, or making use of the website and its subdomains, clients consent to agree to these terms and conditions unconditionally.
9.2 ZEN Interiors reserve the right to change these terms and conditions without notification, so clients must ensure to occasionally review them for any changes.
